Terms & Conditions

Effective Date: August 22, 2026

These Website Terms and Professional Disclaimer (“Terms”) govern your access to and use of jfmadr.com and jfmadvisorypro.com and any page that links to these Terms (collectively, the “Website”). The Website is operated by JFM Advisory and ADR Services, LLC (“JFM,” “we,” “us,” or “our”). By accessing or using the Website, you acknowledge these Terms. If you do not agree, do not use the Website.

1. Informational Purpose Only

The Website provides general information about JFM, its professional background, service areas, and selected topics. Website content is not tailored to any person’s facts or circumstances and does not constitute legal, regulatory, compliance, investment, tax, accounting, financial, or other professional advice. You should obtain advice from appropriately qualified professionals before acting or refraining from acting based on Website content.

Laws, regulations, regulatory interpretations, institutional rules, professional standards, and market practices change. Although JFM may update Website content, JFM does not undertake to keep every item current, complete, or accurate and makes no representation that any content reflects the law or practice as of the date you view it.

2. No Professional Relationship or Engagement

Accessing the Website, downloading material, subscribing to an update, sending an email, or submitting an inquiry does not create an attorney-client, consultant-client, adviser-client, neutral-party, fiduciary, or other professional relationship with JFM or any JFM professional. JFM accepts an engagement or appointment only through an express written agreement or written acceptance after any required conflicts, independence, competence, availability, and other reviews are completed.

Website content does not modify the terms of any separate engagement letter, arbitral appointment, mediation agreement, institutional rule, confidentiality agreement, or other written arrangement. If these Terms conflict with a signed agreement governing professional services, the signed agreement controls for those services.

3. Communications, Confidentiality, and Conflicts

DO NOT SEND SENSITIVE MATTER INFORMATION
Do not send confidential, privileged, proprietary, sensitive personal, or substantive case information through the Website or ordinary email. Website submissions may not be secure, are not treated as formal service or filing, and may not be sufficient to preserve confidentiality or privilege.

An unsolicited communication does not obligate JFM to keep the communication confidential, does not prevent JFM from working with another person, and does not reserve, appoint, retain, or disqualify JFM or any JFM professional. Before sending information about a potential matter, provide only the minimum information reasonably necessary to identify relevant parties, counsel, organizations, and the general nature of the matter for an initial conflicts and availability review.
If you are a party or counsel in a pending or contemplated arbitration, mediation, or other neutral matter, do not send a substantive ex parte communication to a proposed or appointed neutral. Communications must follow the applicable agreement, institutional rules, procedural orders, and directions of the administering institution or neutral.

Scheduling Through Wix Meetings
JFM may provide links to Wix Meetings as a convenience for requesting or scheduling an introductory or administrative meeting. Selecting a time or receiving an automated confirmation does not establish a professional relationship, accept an engagement or neutral appointment, complete a conflicts or independence review, guarantee JFM’s availability, or constitute agreement on the scope or terms of any services. JFM may decline, cancel, or reschedule a meeting when appropriate. Do not place confidential, privileged, sensitive, or substantive matter information in a Wix Meetings guest form or scheduling description.

Use of Wix Meetings is also subject to Wix’s applicable terms and privacy practices. If a scheduling link connects to a calendar or video-conferencing provider, that provider’s terms and privacy practices may also apply. A calendar invitation or video-meeting link is logistical only and does not constitute formal notice, service, filing, or acceptance of an engagement or appointment.

4. Arbitration and Other Neutral Services

Biographical information, matter descriptions, publications, professional affiliations, and disclosures appearing on the Website are general and may not constitute a complete, matter-specific, or current disclosure record. Parties and counsel remain responsible for following the applicable nomination, appointment, disclosure, challenge, and institutional procedures. JFM will make disclosures required by applicable law, ethical standards, institutional rules, and the circumstances of a particular matter through the appropriate process.Nothing on the Website is an indication of how JFM or any JFM professional would decide, evaluate, mediate, or otherwise address any issue or dispute. Prior matters, professional experience, publications, presentations, or viewpoints do not predict an outcome and do not compromise the independent analysis required in each matter.

5. Regulatory and Compliance Advisory Services

Descriptions of regulatory or compliance services are general and do not promise any particular result, regulatory treatment, examination outcome, enforcement disposition, approval, or absence of risk. Regulatory responsibility remains with the client and its governing persons unless a written agreement expressly provides otherwise. Website content should not be treated as a substitute for legal advice, formal interpretation by a regulator, or advice tailored to a specific regulated entity, product, transaction, or jurisdiction.

6. No Guarantee of Results

Professional experience, representative capabilities, credentials, testimonials, rankings, or descriptions of prior work do not guarantee or predict future results. Outcomes depend on facts, governing law, decision-makers, counterparties, evidence, process, market conditions, and other circumstances beyond JFM’s control.

7. Permitted Use

JFM grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Website for lawful informational purposes. You may print or download a reasonable number of pages for your own internal, non-commercial use, provided you retain all copyright and proprietary notices.

  • Use automated means to scrape, harvest, index, or extract Website content or personal information except as permitted by applicable law and standard search-engine practices;

  • Misrepresent Website content, remove proprietary notices, or imply JFM’s endorsement, appointment, or participation without written authorization; or

Third-party names and marks belong to their respective owners. No license is granted except for the limited use expressly stated in these Terms.

9. Third-Party Links and References

The Website relies on or may link to third-party services, including GoDaddy infrastructure and Wix Meetings, and may connect scheduling links to calendar or video-conferencing providers. It may also link to arbitral institutions, regulators, professional organizations, publications, social-media platforms, directories, or other third parties. Links and integrations are provided for convenience and do not imply endorsement, sponsorship, affiliation, or responsibility. JFM does not control third-party content, availability, security, terms, or privacy practices. Your use of a third-party service is governed by that third party’s applicable terms and policies.

10. No Formal Notices, Filings, or Service

Use the procedures and addresses designated in the applicable agreement, rules, procedural order, institutional instructions, or written engagement.

11. Website Availability and Changes

JFM may modify, suspend, restrict, or discontinue any part of the Website or its scheduling functionality at any time. Website and scheduling availability may depend on third-party infrastructure and services supplied by GoDaddy, Wix, connected calendar providers, and video-conferencing providers. JFM does not warrant that the Website or Wix Meetings will be uninterrupted, error-free, secure, compatible with every device, or free from harmful components. You are responsible for using appropriate security protections and maintaining copies of materials you choose to rely upon.

12. Disclaimer of Warranties

JFM DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AND QUIET ENJOYMENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THE FOREGOING MAY NOT APPLY TO YOU.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JFM AND ITS MEMBERS, PROFESSIONALS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITY, OR GOODWILL, ARISING FROM OR RELATED TO THE WEBSITE OR RELIANCE ON ITS CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, JFM’S AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING SOLELY TO YOUR USE OF THE WEBSITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED. They do not alter any liability allocation contained in a separate written agreement governing professional services.

14. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless JFM and its members, professionals, employees, contractors, and agents from third-party claims, liabilities, damages, judgments, and reasonable costs arising from your unlawful use of the Website, your material violation of these Terms, or your infringement of another person’s rights. This section does not require indemnification for JFM’s own conduct to the extent such indemnification is prohibited by law.

15. Privacy

JFM’s collection and use of information through the Website is described in the Website Privacy Policy, available at jfmadr.com/privacy.

16. Governing Law and Forum

These Terms and any dispute arising out of or relating to the Website or these Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Subject to any non-waivable right under applicable law, the state and federal courts located in New York County, New York, will have exclusive jurisdiction, and you and JFM consent to personal jurisdiction and venue in those courts.
This forum provision concerns disputes about the Website and these Terms. It does not determine the forum, seat, governing law, or procedures for any consulting engagement, arbitration, mediation, or other professional matter, which are governed by the applicable written agreement, rules, order, or appointment terms.

17. Changes to These Terms

JFM may update these Terms by posting a revised version with a new effective date. Changes apply prospectively when posted unless otherwise stated or required by law. Your continued use of the Website after an update constitutes acknowledgment of the revised Terms.

18. General Provisions

If any provision of these Terms is held unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. JFM’s failure to enforce a provision is not a waiver. These Terms, together with the Website Privacy Policy, constitute the entire agreement concerning use of the Website, but do not replace any separate written agreement for professional services.
