Privacy Policy

1. Scope and Who We Are

This Privacy Policy explains how JFM Advisory and ADR Services, LLC (“JFM,” “we,” “us,” or “our”) collects, uses, discloses, and protects information in connection with jfmadr.com and jfmadvisorypro.com and any page that links to this Policy (the “Website”).This Policy applies to information collected through the Website. It does not govern information handled under a separate consulting engagement, arbitral appointment, mediation, investigation, expert engagement, confidentiality agreement, institutional rule, or other written agreement. If another agreement or applicable professional obligation governs particular information, that agreement or obligation controls to the extent of a conflict.

2. Information We Collect

Information you provide
We may collect information you choose to provide, such as your name, organization, job title, email address, telephone number, and the contents of a message or inquiry. When you use Wix Meetings to request or schedule a meeting, we and Wix may collect your name, email address, telephone number if requested, selected date and time, time zone, meeting type, responses to guest-form questions, scheduling preferences, and other information you submit in connection with the meeting request. We may also collect information reasonably needed to provide event registration, publication subscriptions, or document downloads if those features are offered.


IMPORTANT CONFIDENTIALITY NOTICE
Do not submit confidential, privileged, proprietary, sensitive personal, or case-related information through a Website form or ordinary email. An inquiry does not establish an attorney-client, consultant-client, neutral-party, fiduciary, or other professional relationship; does not constitute acceptance of an engagement or appointment; and does not complete any conflicts review.

Information collected automatically

When you visit the Website, JFM and its service providers, including GoDaddy and Wix where applicable, may automatically receive technical and usage information, including your IP address, browser and device type, operating system, referring page, pages viewed, approximate location derived from IP address, date and time of access, and security or diagnostic events. This information may be collected through server logs, cookies, pixels, scripts, or similar technologies.


Information from third parties
We may receive information from service providers that support the Website and its features. GoDaddy may process hosting, infrastructure, DNS, security, and server-log information. Wix processes information needed to provide Wix Meetings and may provide us with meeting requests, contact details, meeting status, scheduling history, and related communications. If Wix Meetings is connected to a calendar or video-conferencing service, scheduling information may also be provided to that service so that invitations and meeting access can be created. We may also receive information from analytics, email, content-delivery, professional-directory, arbitral-institution, referral, social-media, or embedded-media providers. Each third party’s privacy practices govern information it processes for its own purposes.

3. How We Use Information
  • Respond to inquiries and communicate with you;

  • Evaluate a potential consulting engagement, neutral appointment, or other professional matter, including an initial conflicts check;

  • Operate, secure, maintain, troubleshoot, and improve the Website;

  • Understand Website use and the effectiveness of our professional communications;

  • Provide publications, event information, or other material you request;

  • Maintain business, compliance, security, and recordkeeping functions;

  • Protect JFM, Website visitors, clients, parties, counsel, and others; prevent fraud, abuse, or security incidents; and enforce our Website Terms; and

  • Comply with law, regulation, legal process, professional obligations, institutional rules, or lawful governmental requests.

4. Cookies, Analytics, and Similar Technologies

The Website, GoDaddy, and Wix may use cookies and similar technologies that are necessary for site operation, security, scheduling, user preferences, performance measurement, or limited analytics. Wix Meetings may use cookies or local-storage technologies to operate its scheduling pages and remember relevant settings. Browser settings may allow you to block or delete cookies, although doing so may affect Website or scheduling functionality. Where legally required, JFM will provide a mechanism to manage consent for non-essential cookies.


JFM does not use information collected through the Website to sell personal information or for cross-context behavioral advertising. If JFM later adds advertising technology, a newsletter platform, enhanced analytics, or other materially different tracking, JFM will update this Policy and provide any legally required notice or choice mechanism. Because there is not yet a uniform industry response to browser “Do Not Track” signals, the Website may not respond to them. JFM will honor legally required opt-out preference signals, such as Global Privacy Control, when and to the extent applicable to JFM’s actual practices.

5. How We Disclose Information

JFM may disclose information in the following circumstances:

  • Service providers. To GoDaddy for Website hosting, infrastructure, DNS, security, and related technical services; to Wix for Wix Meetings scheduling; and to vendors performing analytics, email, calendar synchronization, video conferencing, document delivery, professional technology, or related services, subject to appropriate restrictions;

  • Professional and institutional purposes. To advisers, insurers, auditors, arbitral or mediation institutions, or other persons when reasonably necessary to evaluate or administer a potential or accepted engagement and consistent with applicable duties;

  • Legal and safety purposes. When JFM reasonably believes disclosure is required or permitted by law, legal process, professional rule, court order, or to protect rights, safety, integrity, or security;

  • Business transactions. In connection with a reorganization, merger, financing, sale, transfer, or similar transaction involving all or part of JFM, subject to appropriate protections; and

  • At your direction or with your consent.

 

JFM does not sell personal information for money and does not share personal information for cross-context behavioral advertising, as those terms are generally used in U.S. state privacy laws.

6. Retention

JFM retains Website information only for as long as reasonably necessary for the purposes described in this Policy, including responding to an inquiry, performing conflicts and risk checks, maintaining appropriate business records, protecting legal rights, and satisfying legal, regulatory, professional, insurance, or security requirements. Retention periods vary according to the nature and context of the information. JFM may delete or de-identify information when it is no longer reasonably needed, subject to applicable obligations and litigation holds.

7. Security

JFM uses administrative, technical, and physical safeguards designed to protect information appropriate to its nature and the risks involved. No website, email transmission, or storage system is completely secure, and JFM cannot guarantee absolute security. You should not use the Website or ordinary email to transmit sensitive case materials, evidence, financial account information, government identifiers, health information, or other highly confidential information.

8. Your Choices and Requests

You may request access to, correction of, or deletion of personal information that you have provided through the Website, or withdraw from non-essential communications, by contacting JFM as described below. JFM will evaluate and respond to requests as required by applicable law and may need to verify your identity. Certain information may be retained where permitted or required for conflicts, professional responsibility, security, legal, recordkeeping, or other legitimate purposes.


If JFM sends an optional marketing or publication email, you may use its unsubscribe mechanism. Transactional or matter-related communications may continue where appropriate.

9. State-Specific Privacy Information

Depending on where you live and whether a particular privacy law applies to JFM, you may have additional rights concerning your personal information. JFM does not waive any right provided by applicable law. California residents may also request information about categories of personal information collected and disclosed as described in this Policy. JFM does not currently sell personal information or share it for cross-context behavioral advertising.


California’s “Shine the Light” law may permit certain residents to request information about disclosures of personal information to third parties for their own direct-marketing purposes. JFM does not disclose Website personal information to third parties for their own direct-marketing purposes.

10. International Visitors

JFM is based in the United States. If you access the Website from another country, information may be processed and stored in the United States, where privacy laws may differ from those in your jurisdiction. JFM’s professional services are not offered in a jurisdiction merely because the Website can be accessed there.

11. Third-Party Sites and Services

The Website uses or may link to third-party services, including GoDaddy and Wix Meetings, and may connect Wix Meetings to a calendar or video-conferencing provider. The Website may also link to professional directories, arbitral institutions, social-media platforms, mapping services, or other websites. JFM does not control those third parties, and this Policy does not replace their privacy notices. Review the applicable third-party notices before providing information. 12. Changes to This Policy

JFM may update this Policy from time to time. The revised version will be posted on the Website with an updated effective date. If a change is material, JFM will provide any additional notice required by applicable law.
